Terms of sale

Please read section 5 (exclusion of liability after shipping) and section 6 (warranty) in particular.

1. Scope

These terms apply to all sales of trading cards by Lunoris Cards (“seller”) via Lunoris Cards. These are private sales.

2. Request and conclusion of contract

The presentation of cards on this website is not a binding offer. Your request is free and non-binding.

After receiving your request I check availability and send you an offer including payment details by email. The sales contract is concluded when you accept this offer (e.g. by replying or paying). If the offer is not accepted within 3 days, I may release the cards again.

3. Prices and payment

All prices are in Swiss francs (CHF). As a private sale, no VAT is shown.

Payment by TWINT, bank transfer or cash on pickup. Items are shipped once payment has been received.

4. Shipping and pickup

Shipping by A-Post for CHF 1.30; from 5 cards A-Post shipping is free. On request, shipping by registered mail with tracking; the additional cost is borne by the buyer.

Shipping within Switzerland and to Liechtenstein; other countries on request. Pickup by arrangement.

5. Transfer of risk and exclusion of liability after shipping

As soon as the item is handed over to Swiss Post (or another carrier), benefit and risk pass to the buyer (Art. 185 para. 2 Swiss Code of Obligations).

The seller accepts no liability for loss, theft, damage or delay of the item in the postal system. This applies in particular to A-Post items without tracking, for which no proof of delivery is possible. Replacement or refund is excluded in such cases.

Cards are packed carefully (sleeve and toploader or cardboard reinforcement). To reduce the transport risk, choose registered mail.

For pickup, the risk passes when the cards are handed over.

6. Warranty

Cards are sold used and without any warranty (Art. 199 Swiss Code of Obligations), to the extent permitted by law. The photos show the actual card being sold; its condition is visible in the photos. Returns and exchanges are excluded.

7. Liability

Any further liability of the seller is excluded to the extent permitted by law. Liability for unlawful intent or gross negligence remains reserved (Art. 100 Swiss Code of Obligations).

8. Governing law and jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the seller's domicile, unless mandatory statutory provisions provide otherwise.
